Kinetic Spring Refer & Earn Contest Rules and Regulations (“the Rules”)

1. Eligibility: This Spring Refer & Earn Contest (the “Spring Contest”) is only open to Kinetic customer participants of the Kinetic Refer & Earn Program (the “Program”), who are 18 years of age or older, a resident of the United States, and meets the Criteria below (at the time of entry) (“Eligible Entrant”). Only current Kinetic customers who are in good standing are eligible to enter this Spring Contest. This Spring Contest is void where prohibited by law. The Spring Contest is subject to all applicable federal, state and local laws and regulations.  

2. Agreement to Rules: By participating, you agree to be unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. You are subject to disqualification if you don’t meet the eligibility requirements. In addition, you agree to accept the decisions of Kinetic as final and binding as it relates to the Spring Contest. The winner will be determined by criteria outlined in these Rules.

3. Contest Period: The Spring Contest begins April 1, 2026 at 12:01 AM Eastern Time (ET) and ends May 31, 2026 at 11:59 PM ET. (the “Contest Period”).

4. How to Enter: Spring Contest entrants are automatically entered by submitting a Qualified Contest Referral, as defined herein, through the Go Kinetic portal (the “Platform”) at any time during the Contest Period. No Eligible Entrants will be accepted after the Contest Period ends. The Eligible Entrant must fulfill all Spring Contest requirements, as specified, to be eligible to win a Prize. Entries that do not adhere to the rules or specifications may be disqualified at the sole discretion of Kinetic. You must provide any information requested by Kinetic in relation to the Spring Contest. If you use fraudulent methods or otherwise attempt to circumvent the Rules, in addition to any other legal remedy taken, you may be removed from eligibility at the sole discretion of Kinetic; this includes, but is not limited to, falsification of referrals, illegal (or unethical) referral techniques, or failure to abide by Program terms and conditions. Entry into the Spring Contest requires ongoing compliance with the Program terms and conditions; non-compliance may result in disqualification.

5. Winner Determination: Subject to verification of eligibility and compliance with the terms of these Rules, three (3) winners will be selected at the sole and exclusive judgment of Kinetic and its management. The Spring Contest will be run through the Platform, which will provide periodic updates on referral activity and status. Winners will be determined based on the total number of Qualified Contest Referrals credited to each Eligible Entrant during the Contest Period. Qualified Contest Referrals are referrals which are entered into the Platform, are properly attributed to an Eligible Entrant, that place an order for new Kinetic Internet services during the Contest Period and except as expressly modified in these Rules, satisfies all requirements of a “Qualified Referral” set forth in the Program terms and conditions (“Qualified Contest Referral”). Winners will be the three (3) Eligible Entrants with the highest number of Qualified Contest Referrals recorded in the Platform during that Contest Period. Kinetic reserves the absolute right to add to or change the Qualified Contest Referral criteria and Kinetic Refer and Earn Program terms and conditions at any time. If there is a tie, Kinetic will select the winner by the most overall referrals credited to the tied Eligible Entrants during the last twelve (12) months, whether within the Contest Period or not, as recorded in the Platform.

6. Prizes: The following prizes (each a Prize and collectively, the “Prizes”) will be awarded as described herein.

Selection Timing: On or before June 15, 2026, Kinetic will select three (3) winners using the Winner Determination criteria above.

Prize Restrictions: Limit one (1) Prize per person. Kinetic may restrict how many prizes an Eligible Entrant can receive in future contests or in a calendar year. If a participant is confirmed as a winner in the Contest Period, they are ineligible to win any prize in the future contests during the calendar year. Additionally, individuals who have earned, in aggregate, more than $15,000 in rewards for the under the Program in the calendar year are ineligible to win a Prize.

Prizes Description: Three (3) Prizes will be awarded. Prizes are a digital reward valued at $200.00 redeemable via a Kinetic Disbursement Link, which provides access to a curated catalog of reward options (e.g., streaming, retail, etc. reward card or digital wallet redemption). Specific brands, merchants, or payment card providers are not guaranteed; available options may vary. Approximate retail value of a Prize is $200.00.

The specifics of the Prize awarded shall be solely determined by Kinetic. No substitutions for other goods, services, or other stores of value. Prizes are non-transferable. Any and all Prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. Acceptance of Prize constitutes permission for Kinetic to use winner's name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

  7. Odds: The odds of winning depend on the number of Eligible Entries who qualify, referrals made, conformance to the Qualified Referral criteria, and any other criteria defined for the Spring Contest.

8. Winner Selection and Notification: Winners of the Spring Contest will be selected using the Winner Determination criteria above, but Kinetic reserves the right to change those criteria through the term of this Spring Contest. Winners will be notified via the Eligible Entrant’s e-mail registered in the Platform within five (5) days following the winner selection. Kinetic shall have no liability for a winner's failure to receive notices due to winner’s spam, junk e-mail or other security settings or for winner’s provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the Prize within fifteen (15) days from the time award notification was sent, or fails to timely return a completed and executed declaration and release or other documentation as required, Prize may be forfeited, and an alternate winner selected.

The receipt by winner of the Prize offered in this Spring Contest is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY A WINNER WILL RESULT IN SUCH WINNER’S DISQUALIFICATION FROM THE SPRING CONTEST.

9. Rights Granted by You: In the event you win this Spring Contest, you understand that Kinetic, anyone acting on behalf of Kinetic, or its respective licensees and successors will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your entry, including, without limitation, the entry and winner's name, portrait, picture, voice, likeness, image or statements about the Spring Contest, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.

10. Terms: Kinetic reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Spring Contest should a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Spring Contest. In such case, Kinetic may select from Qualified Contests Referrals from Eligible Entrants received prior to and/or after (if appropriate) the action taken by Kinetic using the Winner Determination criteria above. Kinetic reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Spring Contest or Kinetic referral platforms or violates these Rules.

Kinetic has the right, in its sole discretion, to maintain the integrity of the Spring Contest and determine what constitutes a Qualified Contest Referral, including the right void referrals for any reason. Referrals may be voided for multiple entries from the same referral; fraudulent referrals, referrals that were not entered properly in Kinetic’s referral platform, or referrals contrary to Rules or spirit of the Spring Contest.

Any attempt by an ELIGIBLE entrant to deliberately damage any website, referral platform, or undermine the legitimate operation of the SPRING Contest may be a violation of criminal and civil laws and should such an attempt be made, Kinetic reserves the right to seek damages from any such person to the fullest extent permitted by law. 

  11. Limitation of Liability: By your entry, you agree to release and hold harmless Kinetic and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such Eligible Entrant's participation in the Spring Contest and/or his/her acceptance, possession, use, or misuse of any Prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any referral or sales platforms, computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the promotion; (v) electronic or human error which may occur in the administration of the promotion or the processing of entries.

12. Disputes: THIS SPRING CONTEST IS GOVERNED BY THE LAWS OF THE STATE OF ARKANSAS, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Spring Contest, participant agrees that any and all disputes which cannot be resolved between the parties and causes of action arising out of, or connected with, this Spring Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Arkansas having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e. costs associated with entering this Spring Contest), and participant further waives all rights to have damages multiplied or increased.
